TERMS OF SERVICE

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Rebecca Rose Fine Portraits ("we," "us," or "our"), governing your use of our website rebeccarosefineportraits.com and your engagement with our photography and portrait services.

By accessing our website, submitting an inquiry, booking a session, or providing your contact information, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

 

2. Services

Rebecca Rose Fine Portraits offers professional fine portrait photography services including but not limited to:

  • Portrait photography sessions

  • Fine art and family portraits

  • Session consultations and planning

  • Image delivery and print products

All services are subject to availability and the specific terms agreed upon at the time of booking.

 

3. Bookings and Appointments

3.1 Session Booking

Sessions are booked upon receipt of a signed agreement and any required session fee or retainer. Bookings are confirmed only when you receive written or electronic confirmation from Rebecca Rose Fine Portraits.

 

3.2 Cancellations and Rescheduling

Cancellation and rescheduling policies will be outlined in your individual session agreement. In general:

  • Session fees or retainers are non-refundable unless otherwise specified in writing.

  • We require reasonable advance notice for rescheduling requests.

  • We reserve the right to reschedule sessions due to photographer illness, emergency, or circumstances beyond our control.

 

3.3 Late Arrivals

If you arrive late to your scheduled session, we will do our best to accommodate you within the remaining session time. We cannot guarantee additional session time or a refund for time lost due to late arrival.

 

4. SMS / Text Message Communications

4.1 Consent to Receive SMS Messages

By providing your mobile phone number and opting in through our website form or another opt-in method, you consent to receive SMS/text messages from Rebecca Rose Fine Portraits. These messages may include:

  • Appointment reminders and confirmations

  • Session preparation information

  • Promotional offers and special events

  • Follow-up communications related to your session or order

 

4.2 Message Frequency

Message frequency varies. You may receive up to 4 messages per month, with additional messages as needed for appointment coordination.

 

4.3 Message and Data Rates

Message and data rates may apply. Please consult your mobile carrier for applicable charges.

 

4.4 Opting Out of SMS

You may opt out of SMS communications at any time by replying STOP to any text message we send. After opting out, you will receive one final confirmation message. To opt back in, contact us or re-submit your information through our website.

 

4.5 SMS Help

For help with our SMS communications, reply HELP to any of our text messages or contact us directly using the information in Section 11.

 

4.6 No Third-Party SMS Sharing

Your mobile phone number and SMS opt-in consent will not be sold, rented, or shared with third parties for their own marketing purposes.

 

5. Payment Terms

Payment terms, pricing, and deposit requirements are specified in your individual session agreement. By booking a session, you agree to pay all applicable fees as outlined. All prices are in U.S. Dollars unless otherwise noted.

We accept payment through methods specified at time of booking. Returned payments or chargebacks may result in cancellation of your order and additional fees.

 

6. Intellectual Property

6.1 Ownership of Images

All photographs created by Rebecca Rose Fine Portraits are the exclusive intellectual property of Rebecca Rose Fine Portraits and are protected by copyright law. You may not reproduce, distribute, sell, or modify any images without express written permission.

 

6.2 Client Use Rights

Upon full payment, clients receive a personal use license for the images specified in their session agreement. This license permits personal display and sharing but does not transfer copyright ownership or allow commercial use unless explicitly agreed in writing.

 

6.3 Portfolio and Marketing Use

We reserve the right to use session images in our portfolio, website, and marketing materials unless you have submitted a written request for privacy. If you wish to opt out of marketing use of your images, please notify us in writing prior to your session.

 

7. Client Responsibilities

You agree to:

  • Provide accurate and complete contact and booking information

  • Arrive on time and prepared for your session

  • Obtain any necessary permissions for session locations (if applicable)

  • Treat our staff and contractors with respect

  • Honor payment agreements and timelines

 

8. Limitation of Liability

To the fullest extent permitted by law, Rebecca Rose Fine Portraits shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services or these Terms, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you for the specific service giving rise to the claim.

 

9. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the uninterrupted or error-free availability of our website or services. We do not guarantee specific outcomes from portrait sessions.

 

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which Rebecca Rose Fine Portraits operates, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall first be subject to good-faith negotiation between the parties.
